Cormind Mobile Application Terms of Use

Welcome to the Cormind mobile application (“Application” or “Services”), provided by Cormind Endüstriyel Yazılım ve Danışmanlık A.Ş. (“Company,” “we,” “us,” or “our”).

These Terms of Use (“Terms”) govern your access to and use of our Application. By accessing or using our Services, you agree to be legally bound by these Terms and our Privacy Policy (“Privacy Policy”), which is an integral part of these Terms.

If you do not agree to these Terms, please do not access or use our Services.

1. Acceptance of Terms

By accessing and using our Services, you agree that:

● You have read, understood, and agree to be bound by these Terms.
● You have the legal authority to accept these Terms.
● You will comply with all applicable local, national, and international laws and regulations.

2. Changes to Terms

We may revise or update these Terms at any time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

3. Description and Scope of Services

The Cormind Mobile Application functions as a mobile access interface (“mobile shell”) to our Company’s main Cormind web platform (“Web Platform”).

● Content: All data, reports, and functions you see within the Application related to production, maintenance, quality, energy, traceability, and other modules are essentially a reflection of the Web Platform, and the content is served by the Web Platform.
● Authorization: Your access level and permissions within the Application are determined directly by the permissions defined in your corporate Web Platform account.

4. User Responsibilities and Server Connection

The Application is configured by default to connect to our Company’s servers (e.g., https://test.cormind.com). However, the Application offers you the flexibility to add, delete, and switch between different server addresses (“endpoints”).

You acknowledge and agree that:

● You are solely responsible for the security, content, and data processing practices of any custom or third-party server addresses you add to the Application.
● The Company cannot be held liable for data loss, security breaches, or incorrect content originating from any server you connect to other than the default Cormind servers.

5. Account, Credentials, and On-Device Data Storage

To use the Service, your existing Cormind Web Platform credentials (username and password) are required.

● Secure Storage: To ensure session continuity and facilitate login, the Application stores your sensitive credentials (passwords, cookies, and API tokens) in an encrypted manner on your device’s secure storage (Expo SecureStore).
● Session Data: Non-sensitive session information, such as your user profile, permissions, language/theme preferences, and server list, is stored in your device’s local storage (AsyncStorage).
● Automatic Re-login: When your session expires, the Application may attempt to automatically log you back in using these securely stored credentials to provide an uninterrupted experience. If it fails, you will be directed to the manual login screen.
● Logout: You can clear all stored credentials and session data from your device at any time by using the “Logout” option.

6. Device Permissions and File Management

The Application acts as a bridge between the Web Platform and your device and may request permissions from your device for certain functions:

● File Downloading and Storage: Reports (e.g., Excel, PDF) triggered for download from the Web Platform are intercepted by the Application. To save these files to your device’s file system or to a specific album in your “Media Gallery” (Photos), you will be prompted for storage/media library permission.
● File Sharing: If you do not grant storage permission for downloaded files, or if the file type is not supported for saving, the system’s native sharing panel may be opened to allow you to share the file via other applications on your device (e.g., email, messaging).
● Future Permissions: Even if not actively used at present, the Application may request permissions for the Camera (e.g., for barcode scanning or photo uploads), Photo Gallery (for file selection), or Push Notifications to add functionality in future releases. These permissions will be requested for your approval separately when the relevant feature is introduced.

7. Third-Party Links and Services

The Services may contain links to third-party websites or services that are not owned or controlled by the Company (e.g., the “Privacy Policy” link in the Settings menu, the “Support” email client, or the “Complaint/Suggestion” portal (CloudOffix)).

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. You acknowledge that your use of such sites is at your own risk.

8. Intellectual Property Rights

The Application itself (the mobile shell code, design, trademarks) and all content, features, and functionality accessed through the default Cormind servers (“Content”) are owned by the Company or its licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-transferable, non-exclusive license to access and use the Services for your personal, internal business use in accordance with these Terms.

9. Prohibited Uses

You agree to use the Services only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

● Reverse engineer, decompile, or disassemble the Services.
● Introduce any viruses, Trojan horses, or other malicious code into the Services.
● Attempt to gain unauthorized access to any part of the Services, or any servers or systems connected to them.
● Use the Services for any illegal or fraudulent activity.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED TO YOU “AS IS” AND “AS AVAILABLE”. THE COMPANY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICES.

THE COMPANY SHALL NOT BE HELD LIABLE IN ANY WAY FOR ANY DATA BREACH, SECURITY VULNERABILITY, OR DAMAGE ARISING FROM THE USER’S CONNECTION TO NON-DEFAULT (THIRD-PARTY OR INCORRECT) SERVER ADDRESSES DEFINED THROUGH THE APPLICATION’S SETTINGS.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (i) your violation of these Terms or (ii) your use of the Services.

13. Termination

We reserve the right to suspend or terminate your access to the Services immediately, without prior notice, for any reason or no reason, including if you breach these Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any legal action or proceeding arising out of or relating to these Terms or the use of the Services shall be brought exclusively in the Istanbul (Anatolian) Courts and Execution Offices.
